Olympus Pro Advantage Membership Program Terms and Conditions

These Terms and Conditions are between you (“You”, “Your” or “Member”) and Olympus America Inc. (“Olympus” “Our” or “We”), and shall govern the Olympus Pro Advantage Membership Program (“Program”).

Overview

  • Upon receipt and successful processing of Your membership fee (“Membership Fee”), and subject to the Terms and Conditions as provided here in, You will receive the following benefits for one (1) year from the date of Your membership registration:
    • Welcome Kit for New Members
      - which shall include strap, lens wrapping cloth, and 2 free Clean & Check coupons.
    • Expedited Repair or Loaner Equipment
      - Turn around time of three (3) business days or less (shipped within three (3) business days of being received at repair facility) or free loan of equipment if repairs cannot be made in three (3) business days.
    • Extended Limited Warranty for six (6) months on the camera bodies registered under the program
    • Free shipping to and from repair facility for repairs
      - Free Shipping does not apply to shipment of Your product to Olympus for Clean & Check service, but does apply to the return shipment to You from Olympus after Your product has been cleaned and checked.
    • Dedicated prompt when you call in for Pro Advantage Members to ensure you reach an Olympus representative quickly
    • 15% Discount on out of warranty repair, including parts
  • The Program shall only be available for the following Olympus products:
    • OM-D E-M1
    • OM-D E-M5 and OM-D E-M5 Mark II
    • OM-D E-M10 and OM-D E-M10 Mark II
    • PEN F
    • All “PRO” and “Premium” lenses (M.Zuiko standard lenses are excluded)
    • All future OM-D and PEN camera models launched after the above referenced cameras
    • All future “PRO” and “Premium” Lenses
  • A minimum of 2 qualifying camera bodies and 3 lenses are required to participate in the Program. Up to 5 camera bodies and unlimited lenses are eligible to receive the benefit of the program.

Registration

  • During Your purchase of the Pro-Advantage subscription from www.getolympus.com, You will receive directions to complete the Program purchase and upon completion the process You will receive an order number which will also act as Your membership ID number.
  • Your Program year will commence on the date You purchase the Program.
  • You will be able to use any of the offered services once You have completed the Program form and registered the applicable products. Only those products registered will receive the benefit of the Program.
    • Any product changes, additions or substitutions must be coordinated directly with Olympus, and is subject to approval by Olympus at its sole discretion, by contacting Olympus at the service number provided herein.
    • Olympus reserves the right to reject any benefit or services offered on products not registered with the Program.
  • If You have ever activated a Program before, You will not be a “New Member” entitled to those benefits reserved for “New Members”.

Clean & Check Coupons

  • To have Your equipment cleaned and checked, You must contact Olympus at the telephone number provided on Your Pro Advantage Membership page to describe the issue, request the service and to receive shipping information. We will be available Monday to Friday, 9am – 9pm ET. We are closed on weekends and most major holidays. Please have your membership number on hand when you call.
  • Each Clean & Check coupon must be used within the membership year in which it was received, otherwise they will expire upon the expiration of such membership year.
  • Clean & Check coupons can only be used by You and cannot be assigned, transferred or sold, or redeemed for cash.
  • Services performed:
    • Exterior cleaning
    • Sensor cleaning
    • Firmware upgrade
    • Full function check
    • Auto focus accuracy check
    • Image stabilizer check
  • Turn around time of three (3) business days or less (shipped within three (3) business days of being received at repair facility solely for Clean & Check services) or free loan of equipment if the clean and check cannot be completed in three (3) business days.
  • In the event the Olympus discovers a repair that needs to be addressed the Olympus representative will advise You of i) the needed repair; ii) whether such repair falls under the product warranty or any applicable extended warranty; and iii) if there are any applicable costs for the repair.
  • If You elect to have Your equipment repaired, the Olympus representative will complete the clean and check first, then coordinate the repair of the equipment.
  • If during a clean and check a needed repair is discovered and You elect to have Your equipment repaired, You may receive a complimentary loaner equipment if from the time to complete the repair of the equipment from the time it is received for repair (ie. after the clean and check is performed) will take longer than three (3) days.
  • Please see the provision titled “Expedited Repair” if You elect to have Your product repaired.
  • For Clean & Check there is no “Free Shipping” for shipping Your equipment to Olympus, only on the return.

Expedited Repair

  • To have Your equipment repaired, You must contact Olympus at the telephone number provided on Your Pro Advantage Membership page to describe the issue, request the service and to receive shipping information. We will be available Monday to Friday, 9am – 9pm ET. We are closed on weekends and most major holidays. Please have your membership number on hand when you call.
  • Prior to shipping the product, REMOVE ALL DATA AND/OR DATA SAVING DEVICES FROM THE EQUIPMENT. Olympus shall not be responsible for saving, preserving, or storing any data, nor shall Olympus be liable for the loss, deletion or erasure of any part or all of the data contained, stored or saved within the equipment.
  • Package all equipment You are sending for repair according to the shipping instructions provided by the Olympus representative or found on the Olympus website. Olympus shall not be liable for any equipment damaged during transit.
  • Upon receipt, the Olympus representative shall inspect the equipment, evaluate the issue and determine if such equipment is covered under the limited warranty for the respective equipment.
  • If the product falls under the limited warranty (including any extension of the limited warranty if applicable) the Olympus representative shall perform the needed repair and have the product shipped out to You on the 3rd day from the receipt of the equipment via standard overnight shipping, provided Olympus has the necessary parts and the nature of the issue can be repaired in three (3) days.
  • If the product does not fall under any warranty, the Olympus representative will evaluate and provide You an estimate of the cost for the non-warranty repair, in which You can elect to have the product returned without repair or to have the Olympus representative repair the equipment. The Olympus representative shall perform the needed repair and have the product shipped out to You on the 3rd business day from the receipt of the equipment via standard overnight shipping, provided Olympus has the necessary parts and the nature of the issue can be repaired in three (3) business days.
  • If the equipment cannot be repaired in three (3) business days, Olympus may offer You complimentary loaner equipment for the period of time it will take to complete the repairs. See the section “Complimentary Loaner Equipment” below for details.

Complimentary Loaner Equipment

  • In the event an equipment repair will take longer than three (3) business days to complete, an Olympus representative will contact You to offer, and coordinate the shipment to You of, a complimentary loan of Olympus equipment for the duration of time that Olympus will need to repair Your equipment.
  • Olympus may, at its discretion, send to You the same model or an upgraded model of the equipment You sent in for repair. Such loaner equipment may be used or new.
  • To receive loaner equipment You must:
    • Provide Olympus valid credit card information to secure the loaner equipment;
    • Be in good standing with Olympus (ie. in compliance with the Terms and Conditions of this Program; must not have a history of abuse, fraud, deception, or disparaging activity as against Olympus);
    • Have a valid physical address (PO Box numbers will not be accepted); and
    • Provide any additional information as reasonably requested by Olympus (including but not limited to photo ID, social security/tax identification number, business documents, bank information, and proof of residence).
  • The loaned equipment are and will remain the exclusive property of OAI CPG and must be returned to OAI CPG at the end of the loan period or immediately upon the request of OAI CPG.
  • During the loan period, You shall keep the loaned equipment under Your sole possession and control. You shall not sell, transfer, part with possession of, or sublet any loaned equipment, and You shall keep the loaned equipment free from all liens or encumbrances. You accept complete responsibility and liability for all risk of damage to and loss or destruction of the loaned equipment however, whenever, and by whoever caused (normal wear and tear excepted). You shall at all times operate the loaned equipment in a careful and proper manner, and follow cleaning and maintenance procedures, as applicable, for the loaned equipment as described in any instruction manuals, and in accordance and in compliance with all applicable federal, state, and local laws.
  • Except as specifically set forth in this letter, regardless of any statement in any loaned product insert, manual, literature, or advertising, OLYMPUS MAKES NO REPRESENTATION OR WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTIES OR REPRESENTATIONS AS TO THE MERCHANTABILITY OF THE PRODUCTS OR THE PRODUCTS' FITNESS FOR A PARTICULAR PURPOSE, OR THE VALIDITY OR OWNERSHIP OF ANY PATENTS OR TECHNOLOGY USED OR INCLUDED IN ANY PRODUCTS.
  • Once repaired, Olympus will ship out the repaired equipment to You and contact You, via email or telephone, to advise You of such shipment.
  • Upon receipt of Your equipment, You shall ship the loaned equipment back to Olympus within five (5) days from receipt of Your equipment per the instructions provided to You by Olympus using the return shipping label included with the loaner equipment.
  • If You fail to return the loaned equipment accordingly, or if the loaned equipment is lost, stolen or damaged, Olympus may invoice You for the equipment and/or pursue any and all remedies against You to collect the equipment or the retail cost of new equipment to replace the loaned equipment that was lost, stolen, or that You failed to return, including reimbursement of any attorneys fees and court costs incurred in the collection process.
  • Olympus may request the return of any loaned equipment at any time and for any or no reason prior to the return of Your equipment upon notifying You (via US Mail or Email). Upon the receipt of such request, You must return the loaned equipment immediately.
  • Olympus reserves the right at its sole and absolute discretion to withhold this benefit from You at any time, with or without reason.

Extended Limited Warranty on Your Camera Body (for new members only)

  • Olympus shall extend the current original limited warranty (the warranty the comes with the product) on Your registered camera body(ies) by six (6) months.
  • For this benefit to apply, the limited warranty on Your camera body must be current and valid (ie. it must not be expired), the camera body must not have been purchased from an unauthorized dealer, the camera body must be registered in the Program, and the camera body must not be a grey market product.
  • Upon registration, Olympus will extend the current limited warranty of any registered camera body for a period of six (6) months, starting on the first day from the expiration of the original product limited warranty. The six (6) month extended limited warranty shall be based upon the same terms, conditions and restrictions set forth in the initial limited warranty contained within the original packaging of Your equipment.
  • Any warranty extended or granted herein shall be applicable only within the United States. In other words, if You have a warranty matter that falls within the period of the extended warranty, the extended warranty will only be honored within the US, where You will have to ship such equipment to a US address as instructed by the Olympus representative.
  • All exclusions stated in the initial limited warranty that accompanied the equipment in its original product packaging shall apply.
  • This extended limited warranty shall survive the natural expiration of Your membership year, even if You do not renew. However, this extended warranty shall not survive if Olympus terminates Your membership as the result of Your breach of these Terms and Conditions.
  • This six (6) month limited warranty extension shall NOT apply to extended warranties purchased separately for the registered camera bodies. For clarity, extended warranties will not be extended.

Free Shipping

  • In the event You need to send in any equipment for repair or if You need to return any equipment loaned to You, to cover the cost of the shipment, the Olympus representative will provide You a shipping label to use to send in Your product, or a return shipping label will be provided to You with any loaner equipment.
  • Olympus will cover the costs to ship any equipment or loaned product to You.
  • You will be responsible for any costs related to any shipments made that do not use an Olympus authorized and issued shipping label.
  • Free shipping shall only apply to shipments within the United States (from and to US addresses).

Dedicated Prompt

  • When You call into the Olympus toll free number You will be prompted to select an extension dedicated to Pro Advantage Members. This will expedite the time to reach an Olympus representative to discuss your matter.

15% Discount on Out of Warranty Repair

  • Members will receive a 15% discount off any non-warranty repair cost.
  • In the event an Olympus representative contacts You to inform You that a repair to Your Equipment is not covered by any warranty, the Olympus representative will also provide You an estimate of the cost to have Your equipment repaired and the cost of the repair calculated with the discount.
  • Olympus will not perform any non-warranty repair unless You expressly authorized such repair.
  • If You provide Your authorization, You agree to pay the cost of the repair as provided to You by the Olympus representative.

Miscellaneous

  • Your Membership Fee is non-refundable, unless expressly stated in these Terms and Conditions.
  • Your Membership will automatically terminate upon the expiration of one (1) year and will not renew until We have received and successfully processed Your Membership Fee for the new year of Your membership (“Renewal Year”).
  • The Renewal Year will commence on the date the renewal of the Program is purchased.
  • Olympus reserves the right to reject any membership request or renewal for any reason.
  • You will receive the same benefits referenced above for each Renewal Year, excluding the Welcome Kit.
  • This Program shall only be available to those residing in the United States of America, including the District of Columbia (all other US territories and possessions are excluded). Additionally, only those Olympus products purchased in the United States from authorized resellers in the United States may be registered under, and receive the benefits from, this Program.
  • The Program is not transferable and may not be assigned or conveyed by any means to anyone, including through Your estate, and may not pass to Your successors and assigns.

  • To the extent provided by law, Olympus reserves the right to make promotional offers available to select Olympus account holders based on purchase activity, geographic location, Olympus Program participation, or information supplied by You.
  • The information provided by You will be handled according to the Olympus Privacy Policy. If You are interested in learning more about Olympus privacy practices, please visit www.getolympus.com and click on the Privacy Statement link in the bottom navigation bar.
  • We may terminate the Program and/or Your Membership at anytime without cause at Our discretion by providing You with no less than ten (10) days notice. If We do so prior to the expiration of Your membership, We will reimburse You a portion of Your Membership Fee based on the following scale:
    • Termination on or within the first 20 days = 100% of Your Membership Fee
    • Termination on or within the 21st and 92nd days = 75% of Your Membership Fee
    • Termination on or within the 93rd and 183rd day = 50% of Your Membership Fee
    • Termination on or within the 184th and 274th day = 25% of Your Membership Fee
    • Termination on or within the 275th day 365th day = 0% of Your Membership Fee
  • We may terminate Your Membership for cause, in which no reimbursement will be provided, in the event You do any of the following:
    • Use abusive or obscene language towards any Olympus employee or contractor;
    • Not return any Loaned Equipment timely;
    • Do not pay any monetary obligation timely; transactions involving stop payments, credit reversals, insufficient funds, and credit card denials, if conducted, received or performed on or after a scheduled payment date may be deemed untimely.
    • Provide inaccurate or false information to Olympus;
    • Actually, or attempt to, deceive or defraud Olympus;
    • Failing to follow these Terms and Conditions;
    • Conducting any fraudulent or illegal activities, including but not limited to “hacking”;
    • Participating in any activity disparaging to or not in the best interest of Olympus or other Olympus account holders, or conducting any other improper conduct as determined by Olympus in its sole judgment.
  • In connection with the enforcement of any of the Terms and Conditions governing the Program, Olympus reserves the right to take appropriate legal action, as it deems necessary, and to recover damages, attorneys’ fees and court costs.
  • A person or entity that subsequently creates a new Program account under the same or different name after the termination or expiration of a prior account shall not be deemed a new member.
  • Our failure to insist upon or enforce Your strict compliance with these Terms and Conditions will not constitute a waiver of any of Our rights.
  • These Terms and Conditions are void to the extent where prohibited by law. If any provision within these Terms and Conditions are deemed to be unenforceable shall not cause the remaining provisions to be unenforceable. Such remaining provisions shall continue to be in full force and effect.
  • Taxes may apply where required by law.
  • Olympus may, at its sole and absolute discretion, change or revise the Program Terms and Conditions, benefits, or conditions of participation, in whole or in part, at any time, including the products to which this Program is available. Upon any such change, Olympus will post such changes on the Program information page. It is Your responsibility to be aware of any such changes.
  • IN NO EVENT SHALL OLYMPUS BE LIABLE FOR LOSS OF PROFITS, LOSS OF USE OR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES OF ANY KIND THAT MAY RELATE TO YOUR PARTICIPATION IN THIS PROGRAM.
  • All determinations by Olympus shall be final and conclusive in each case. These Terms and Conditions supersede all previously published terms and conditions.
  • This Program and these Terms and Conditions shall be governed by the laws of the Commonwealth of Pennsylvania, without reference to its conflict of laws provisions therein.
